Cancellation / Refund Policy Show Management must receive all exhibitor participation cancellations, in writing via certified mail (return receipt requested). The date of cancellation shall be the date that Show Management receives written cancellation. If Show Management does not receive notice of cancellation, in writing via certified mail (return receipt requested), the Exhibitor will be liable for 100% of the exhibition cost (full amount of exhibition costs). Exhibitor Deposits are NON-REFUNDABLE and NON-TRANSFERABLE. Both the Exhibitor and Show Management acknowledge that, in the event of exhibitor cancellation, Show Management will sustain substantial monetary losses that cannot precisely be determined. Due to the difficulty in determining and detailing said losses, the Exhibitor agrees to pay the following if Exhibitor cancels its participation. If written notice of cancellation is received sixty days prior to Show, Exhibitor agrees to pay 50% of the total exhibition cost. If written notice of cancellation is received thirty days prior to show or less, Exhibitor will be liable for 100% of the total exhibition cost. Booth deposits, Sellers Permits, Insurance Cost, Electricity Costs, Spotting Costs, Temporary Food Permit Cost, & late payment costs are all non-refundable. All exhibition cost(s) are payable immediately upon cancellation. If Exhibitor fails to occupy booth space without notice, exhibitor forfeits all exhibit payment cost and deposits made, and will be held liable for any unpaid balances due on Contract. If Exhibitor cancels credit card transactions or processes stop payments on checks before, during or after exhibit dates and participates as an exhibiting vendor during show dates, Exhibitor will have Breached their contract and be liable for 100% of the exhibition costs. Show Management will pursue collection of costs by any means necessary including a court of law. Exhibitor will be liable for all applicable late costs, court cost and attorneys costs incurred. If any unforseen circumstances arise, whereby Show must be cancelled or postponed, Show Management in its sole descrection has the right to postpone the show (change the date and or change venue). If show cannot be re-scheduled within the same calendar year, Exhibitors will be allowed to Exhibit in the next show on calendar at no additinoal cost. If Show is postponed or cancelled by Show Management, and exhibitors decide not to exhibit in an upcoming show, Show Management has 30 to 60 days to refund exhibit booth cost (only). Show Management is not liable for any additional fees and cost or out of pocket expenses made by Exhibitor in connection with its exhibit. The above terms shall apply regardless of the execution date of the Contract.
EXHIBITOR BREACH Show Management reserves the right to cancel the Exhibitor’s participation if the Exhibitor breaches any of its obligations or does not comply with the terms and conditions of the Contract including, but not limited to, making any payment that is due as per the Contract. If Show Management does cancel the Exhibitor as per this section, the Exhibitor will have been deemed to have canceled its own participation and thus subject to adhere to the provisions as stated in the Cancellation Policy above. The date of cancellation shall be the date that Show Management cancels the Exhibitor for breach.
INTEREST AND COLLECTION COSTS Any exhibitor that does not meet all financial obligations when due will be responsible for all outstanding debts, interest at one and one-half percent (1.5%) per month and any costs (including attorney’s costs and/or collection costs of not less than 25% of the remaining balance due) Show Management incurs to recover the debt. There will be a $45.00 charge for all returned checks. If the above interest amount, attorney’s costs and/or collection costs, and returned check costs exceed the limits allowed by applicable laws, then the maximum interest and such costs as allowed by such laws shall be paid to Show Management by the Exhibitor.
